Protection of Personal Data

  1. The operator of the Platform [www.upwind24.pl] hereinafter referred to as the "Platform", is Stanisław Klimaszewski conducting business activity under the name Stanisław Klimaszewski UPWIND with headquarters in Giżycko, ul. Rolnicza 57, 11-500 Giżycko, VAT: 8451919123; REGON: 281595082, hereinafter "Upwind24".
  2. Upwind24 makes every effort to ensure the privacy of users and the protection of personal information provided by them while using and making purchases on the Platform.
  3. Personal Data is processed on the Platform to enable the use of Platform functionalities, including automatically during its use. The Platform collects information voluntarily provided by the user, additionally the Platform may store information about connection parameters (time, IP address). Data provided in the form is processed for the purpose resulting from the specific form function, e.g. for registering for regattas or commercial contact. Providing Personal Data in forms on the website is voluntary and requires consent, however, it is necessary to conclude a contract.
  4. The user is entitled to access their Personal Data, correct them, delete them, and request the limitation of processing at any time, as well as have the right to request their deletion. To exercise the above rights, you should contact Upwind24 via an account created on the website www.upwind24.pl, by letter to the business address, by email to the addressadmin@upwind24.com.
  5. Personal Data provided may, with the prior, separate consent of the user, be used to provide information about new products, offers or promotions. In the case of providing the above information electronically, separate consent of the user is necessary to receive them in the above form.
  6. In order to execute concluded contracts and provide ordered services, transactional data, including Personal Data, may be transferred to PayPal Holdings Inc., PayPro S.A. or PayU S.A. to the extent necessary to process payments for the order.
  7. Personal Data collected from regatta applications is transferred to the regatta organizer for the purpose of conducting and servicing the event.
  8. The legal basis for processing Personal Data are:
    • consent of the person whose Personal Data it concerns to their processing;
    • necessity for the performance of contracts concluded on the Platform or through the Platform, or to take action requested by the person whose Personal Data it concerns before concluding a contract;
    • necessity to fulfill a legal obligation incumbent on Upwind24;
    • the legitimate interests pursued by Upwind24 or by a third party, which are electronic payment operators, regatta organizers or others carried out in connection with the functionality of the Platform, provided that this legal basis for processing Personal Data does not concern children.
    In the case referred to in point 8 a), Personal Data concerning children are processed only if the child is over 16 years of age. Otherwise, the consent of the child's legal guardian is required.
  9. Personal Data collected on the Platform will be stored for settlement purposes for a maximum period of 5 years, counting from the end of the calendar year in which the deadline for payment of tax related to the contract concluded on the Platform or through the Platform has expired. In other respects, Personal Data justified by the purposes of processing will be stored as long as there is a legal basis for their processing, unless applicable law requires a longer period of their storage, e.g. for use in proceedings concerning the functioning of the Platform. At the end of the storage period, personal data will be deleted or anonymized.
  10. Personal Data provided by the user may be disclosed to the competent public authorities if such obligation arises from legal provisions.
  11. In order to ensure the security of personal data, Upwind24 applies security procedures such as IT security measures preventing unauthorized access to data.
  12. Every user of the Platform has the right:
    • to access their Personal Data, the right to correct, delete and the right to demand the restriction of processing.
    • to object to the processing of Personal Data, withdraw consent to the processing of Personal Data for one or more purposes for which it was given, at any time without affecting the legality of processing based on consent before its withdrawal, and also the right to transfer their Personal Data.
  13. If the user agrees to subscribe to the newsletter, the user can also give separate consent to use the provided email address for marketing purposes of Products. Consent to subscribe to the newsletter and to use the email address for marketing purposes can be withdrawn by the user at any time.
  14. Personal and address data as well as email address information collected during account registration are not shared with third parties and are used to fulfill obligations towards the user.
  15. User contact details are used to contact the user if necessary.

  17. During purely informative use of the Platform, i.e. without registering or providing us with other information, only personal data that the internet browser sends to the Upwind24 server is collected. When browsing the Platform, data necessary for the correct display of the Platform and ensuring its stability and security is collected (the legal basis is art. 6(1) sentence 1 lit. f GDPR): IP address, date and time of the request, time zone difference from Greenwich Mean Time (GMT), content of the request (specific page), access status/HTTP status code, amount of data transmitted, website from which the request comes, browser, operating system and its interface, language and version of browser software.
  18. Matters not regulated in the Privacy Policy are governed by the legal provisions regarding the processing of Personal Data, including the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (GDPR).
Information about so-called cookies and internet analytics
  1. Upwind24 does not automatically collect data except for data contained in so-called cookies. Cookies - are text files sent by the Platform and stored on users computers. These files contain data related to the use of the website www.upwind24.pl. They remember actions performed using the website and enable the provision of information or Products in which the user is interested. They may be temporary (deleted when the browser is closed) or permanent (stored after closing the browser).
  2. Cookies are not used to obtain personal data of persons visiting the www.upwind24.pl. Visitors can disable the option of so-called cookies. Disabling the option of so-called cookies may be associated with difficulties, or even impossibility of using the Platform.
  3. Consent to the use of so-called cookies is expressed through the internet browser.
  4. Upwind24 uses so-called cookies to recognize the device visiting and customize displayed content to the visitor's needs, enable automatic login to the account created on the Platform, after prior consent, and create anonymous statistics.
  5. In many cases, the software used to browse websites by default allows the storage of so-called cookies. Changes regarding the storage of so-called cookies can be made by configuring settings in internet browsers.
  6. Upwind24 uses the Google Analytics internet analytics service provided by Google Inc. ("Google"). Google Analytics uses so-called cookies. If IP anonymization is activated on this website, the IP address will be shortened by Google within member states of the European Union or in other countries party to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information for the purpose of evaluating the use of the website, compiling reports on website activity and providing other services relating to website activity and internet usage to the website operator.
  7. The IP address obtained from your browser by Google Analytics as part of the service is not merged by Google with other data.

  9. Information regarding the use of NewRelic and ChatWoot systems: Upwind24 uses the NewRelic application performance monitoring system provided by New Relic Inc. ("NewRelic"). This system allows tracking the performance of the Platform and identifying any technical issues to provide users with the highest quality services. NewRelic may collect certain technical data, such as the user's IP address, information about the internet browser, operating system, and the time of visits to the Platform. Upwind24 does not link this data to other user-identifying information.
  10. Upwind24 also uses the ChatWoot customer support system provided by ChatWoot Inc. ("ChatWoot"). This system allows users to communicate with Upwind24 via live chat and report technical issues and questions. ChatWoot may collect data, such as the user's IP address, conversation history, and information provided by users during communication with customer support. This data is used solely for the purpose of providing technical support and improving customer service quality by Upwind24.
  11. Both NewRelic and ChatWoot may use cookies to ensure the proper functionality of their services and collect analytical data regarding the use of the Platform by users. Users can manage cookie settings in their internet browser according to the instructions provided by browser providers.
